Motion to Reconsider Order on Claim

Background:

On June 1, 2015, this event was redesigned. The event should be used to request reconsideration of an order previously entered on a claim. The event now includes a warning referencing Bk Rule 3008, and will require you to relate to the previous order and claim in question. The motion will also appear on the Claim Register.

 

Step by Step Procedures:

  1. Select Bankruptcy > Motions / Applications Tr/UST

     

  2. Enter the Case Number

    • Click Next

     

  3. Verify you are docketing on the correct case

     

  4. Select Reconsider Order on Claim from the pick list

    • Click Next

     

  5. Select the Party from the party pick list or Add/Create new party

    • Click Next

     

    The Attorney/Party Association screen may display.  If it does, click here.

    • Click Next

     

    • Click Next

     

  6. The Claims Options Menu will display: 

    • Select the Claim(s) under reconsideration

    • Click Next

       

  7. Follow the chart based on the radio button selection in step 7

    Proof of Claim Filed on Court Register

    Claim Listed on Schedules, No claim Filed (Chapter 11 only)

    or Claims / Noticing Agent  

    The Claims Selection screen will display: 

    • Select the appropriate radio button

    • Click Next

     

    The PDF screen will display

    The PDF screen will display

     

    The Name of Claimant screen will display

    • Enter the Name of Claimant

    • Click Next

     

  8. The Hearing screen will display

    • Verify or check the box next to the Order on Claim for reconsidered

    • Insert Hearing Date, Time, and Location

    • Click Next

     

  9. The Modify Text screen will display.

    If applicable, you may make a selection from the prefix dropdown box.

     

  10. This is your final opportunity to modify the entry before submitting the filing.

    • Verify the accuracy of the docket text

    • Click Next to complete the filing process

     

     

    The Notice of Electronic Filing will display.  It is the verification that the filing has been sent electronically to the court.

    Copies of this notice and the document filed are emailed to all participants who receive electronic notification in the case.  You have a period of 15 days for a one time free look at the document filed.
