Motion to Reconsider Order on Claim

Background:

On June 1, 2015, this event was redesigned. The event should be used to request reconsideration of an order previously entered on a claim. The event now includes a warning referencing Bk Rule 3008, and will require you to relate to the previous order and claim in question. The motion will also appear on the Claim Register.

Step by Step Procedures:

1. Select Bankruptcy > Motions/Applications

    

2. Enter the Case Number

   • Click Next

    

3. Verify you are docketing on the correct case

    

4. Select Reconsider Order on Claim from the pick list

   • Click Next

    

5. Select the Party from the party pick list or Add/Create new party

   • Click Next

    

   The Attorney/Party Association screen may display.  If it does, click here.

   • Click Next

    

6. A warning screen will display: 
   

   WARNING: This event should only be used to request Reconsideration of an order allowing or disallowing a claim per BK Rule 3008

   • Click Next

      

7. The Claims Options Menu will display

   • Select the appropriate radio button

   • Click Next

      

8. Follow the chart below based on the radio button selection from step 7 : 

   Proof of Claim Filed on Court Register	Claim Listed on Schedules, No claim Filed (Chapter 11 only) or Claims / Noticing Agent
   The Claims Selection screen will display:  Select the appropriate radio button Click Next   The PDF screen will display Browse, Scan and Attach Attach the proposed order Click Next	The PDF screen will display Browse, Scan and Attach Attach the proposed order Click Next   The Name of Claimant screen will display Enter the Name of Claimant Click Next

    

9. The Hearing screen will display

   • Verify or place a check in the box next to the appropriate Order Allowing or Disallowing

   • Insert Hearing Date, Time, and Location

   • Click Next

    

10. The Modify Text screen will display.
    

    If applicable, you may make a selection from the prefix dropdown box.

     

11. The Final Text screen will display.

     

    Proof of Claim Filed on Court Register radio button selected

    Notice of Motion and Motion to Reconsider Order on Claim #1 (related documents [58] Order on Claim) Filed by (name) on behalf of (name). Hearing scheduled for 4/14/2015 at 10:00 AM at 200 S. Michigan Avenue, Suite 1300, Chicago, Illinois 60604. (Attachments: # (1) Proposed Order) (name)
