Local Rule

Background:

Effective June 12, 2015, an attorney may e-file a Proposed Order to Employer to Pay the Trustee for Chapter 13 cases.

Local Form 13-1: Order to Employer to Pay the Trustee

The court created a fillable form,Local Form 13-1 Order to Employer to Pay the Trustee. The form will allow you to select a Judge and Trustee and enter the name of the employer, debtor and deduction amount in the body of the order.

** For a copy of the form, please access Forms>All Forms>Chapter 13 Forms>Form 13-1 Payroll Deduction Order.

This form MUST be filed using the event Proposed Order to Employer to Pay the Trustee. After review the Clerk's office staff, the order will be dated, signed, and entered on the docket.

Please verify that the trustee you select matches the trustee on the case:

Step-by-Step Procedures:

  1. Select [Bankruptcy>Other ]

  2.  Enter case number and click Next

  3. Select Proposed Order to Employer to Pay the Trustee from event pick list - click Next

  4. Select from the party pick list and click Next

  5. The following message will display:

  6. Click Next

  7. The PDF Document selection screen will display:

    • Click Next

  8. The Modify Text Screen will display:

    • If applicable, click the down arrow to choose a prefix from the pick list.

    • Please ensure the prefix is included in the title of the PDF.

    • Remember - Only add Amended to the PDF and the docket text if a previous order was entered.

  9. Click Next

  10. The Final text screen will display - this is your final opportunity to modify the entry before submitting the filing:

  1. Verify the accuracy of the docket text - If not correct / if correct

  2. Click Next to complete the filing process

The Notice of Electronic Filing will display.  It is the verification that the filing has been sent electronically to the court.

Copies of this notice and the document filed are emailed to all participants who receive electronic notification in the case.  You have a period of 15 days for a one time free look at the document filed.
