Notice of Conversion to Chapter 7 and Splitting Case

According to Local Rule 1019-1;

When only one of two joint debtors files a notice of intent or motion to convert, upon payment of any required additional filing fees, the clerk shall divide the case into two separate cases and assign a case number to the new case.  The debtor seeking to convert his or her case shall give notice to the other debtor, as well as to all other parties entitled to notice under the Bankruptcy Code and Bankruptcy Rules, and shall be responsible for the payment of all required fees.

 

This event can only be filed on a Chapter 12 or Chapter 13 case.  If you attempt to file this event on any other chapter, the system will stop you from completing the filing.

 

This event should not be used when filing a Notice of Conversion that applies to both debtors in a joint case.  Refer to Notice of Conversion to Chapter 7 for further instructions.

 

The clerk's office will file a new case on behalf of the split debtor.  This debtor will be also be terminated from the joint case.

Step-by-Step Procedures:

  1. Select [Bankruptcy>Notices]

  2. Enter case number and click Next

  3. Select Notice of Conversion to Chapter 7 and Splitting of Case from event pick list and click Next

  4. Select Debtor who filing the Notice of Conversion from party pick list

  1. Click Next

The PDF Document selection screen will display.

  1. Click Browse button and navigate to locate the appropriate document/file

  2. View file to verify the correct file is being selected

  3. Click Open button and filename will appear in the browse window

  4. Click Next

  1. Enter name of debtor splitting from the case

This screen will also display the filing fee

  1. Click Next

The Modify Text screen will display.  Click down arrow to select a prefix if applicable.

  1. Click Next

The Final Text screen will display.  This is your final opportunity to modify the entry before submitting the filing.

  1. Verify the accuracy of the docket text.  If not correct/if correct

  2. Click Next to complete filing process

 

Electronic Payment

You have the option to:

Select one of the two options and close the window when done.

The Notice of Electronic Filing will display.  It is the verification that the filing has been sent electronically to the court.

Copies of this notice and the document filed are emailed to all participants who receive electronic notification in the case.  You have a period of 15 days for a one time free look at the document filed.
